PEOPLE smuggling charges against an Afghan refugee living in Perth have been dropped.

Jarajo Zirak, 21, who worked as an interpreter at the Christmas Island detention centre, was arrested in front of his family by Australian Federal Police outside his Thornlie home in April.

Mr Zirak was charged with one count of organising or facilitating the proposed entry into Australia of five or more persons, who are unlawful non citizens, while in Indonesia between May 22 and November 26 last year.

But Commonwealth Director of Public Prosecutions ordered the charges be dropped in Perth Magistrate’s Court on Friday.

Federal police said the charges were withdrawn because of “significant changes in the strength of evidence from the witness” that were beyond the control of the AFP and the CDPP.

Thornlie "tree man" Richard Pennicuik will stand trial in the Armadale Magistrate's Court in October after he pleaded not guilty this afternoon to a charge of obstructing the Gosnells City Council.

Mr Pennicuik spent 110 days up the eucalyptus tree in the front verge of his Hume Road home in protest at the council's plan to cut it down on safety grounds.

Mr Pennicuik, 57, faces one charge of obstructing the City of Gosnells in its bid to remove the tree and is facing fines of $5000 plus $500 for every day he ignored the council's orders to cease his protest.

Magistrate Liz Langdon rejected an application from friend Mark Simonson to appear in court as Mr Pennicuik's "McKenzie Friend" - a term which refers to a legally unqualified person who helps someone in court.

She said the doctor's letter provided by Mr Simonson on Mr Pennicuik's mental illnesses was insufficient and that further medical proof would be required.

She also rejected an application for Mr Pennicuik and the City of Gosnells to submit their dispute for mediation and an application for the trial to be heard at the Perth Magistrate's Court.

Mr Pennicuik's application to have the case struck off was also rejected with Ms Langdon saying that this was a matter that could be argued at the start of his trial.

She dismissed the application against the tree's removal after being informed by City of Gosnells lawyer Peter Gillett that the tree had already been removed.

After the applications were dismissed, Mr Pennicuik pleaded not guilty and Ms Langdon remanded the matter for trial on October 27.

Mr Pennicuik then asked her if she believed that Jesus Christ was the son of God.

When asked by Ms Langdon why the question was relevant to his case, he said: "All the laws are based on a protestant faith and that a person is innocent until proven guilty."

"I agree and that's why we have a trial system," Ms Langdon replied.

Outside court Mr Simonson said Mr Pennicuik suffered from attention deficit disorder, insomnia, anxiety and paranoia and suffered a bipolar disorder.

"He's not fit to stand trial and plead his case," Mr Simonson said.

Another friend of Mr Pennicuik, Mr James Dean - who at his last appearance on May 4 attempted to appear in court as Mr Pennicuik's "McKenzie Friend" - said that an appeal would be made against Ms Langdon's dismissal of the applications.

For most of the day outside the court building signs were displayed by a small group of about 10 supporters which read "Gosnells Council: Environmental Vandals. Sack 'Em" and "Oxygen Thieves".

When Mr Pennicuik appeared in court for the first time on April 6, he refused to enter a plea claiming that his name was not presented correctly on court documents.

Mr Pennicuik spent 110 days living in the tree before climbing down on March 26.

THORNLIE resident Debbie Pagoda wants the same treatment ‘Thornlie tree man’ Richard Pennicuik received when the tree he tried to save was removed.

Ms Pagoda asked to have a verge tree removed from the front of her home by Gosnells City Council, after it fell onto the road during the March 22 storm.

The next day Gosnells City Council chopped the tree in to pieces and left it on the side of Ms Pagoda’s property.

A few days later, the logs were picked up but two large stumps were left.

A week later, Mrs Pagoda called the council and asked for the stumps to be removed.

After another call to council, the stumps were mulched by a machine and left in a large pile on the verge.

“When I asked to have the mulch taken away I was told I could have it for the garden or leave it to decompose, and it was not council’s responsibility to remove it,” Mrs Pagoda said.

“Well I did not need it; it was council’s tree and council’s responsibility and I want an explanation as to why this is not their responsibility.

“The ‘Thornlie tree man’ gets his tree chopped down with all the mess taken away.”

City of Gosnells director of infrastructure David Harris agreed it was the responsibility of council to remove the stump. He said when a large tree was chopped down, council left the pile of resultant mulch on the verge to settle.

“After about four weeks, council checks the site and any remaining mulch is removed,” he said.

“Any mulch that is left at 16 Teakwood’s verge is the responsibility of council and will be removed.

Five people are injured after bricks and bottles were thrown when 30 gatecrashers tried to enter an 18th birthday celebration in Maddington on Saturday night.

Police spokeswoman Ros Weatherall said a man tried to gain entry to a girl's 18th birthday party, held by her 48-year-old mother at a house in Kirin Way.

After being refused entry, the man walked away, only to return with about 30 friends a short time later, Mrs Weatherall said.

A large brawl ensued, in which bricks and bottles were thrown.

The fight spilled out of the house and further along Kirin Street towards Lancaster Street.

Letterboxes, trolley handles and garden stakes were also used as weapons.

The mother received lacerations and bruising and was taken to Royal Perth Hospital.

A 22-year-old Cannington man received a broken finger and skull fracture, and remains in Royal Perth Hospital.

An 18-year-old man of Maddington was also taken to RHP with a suspected broken nose.

A 22-year-old Maddington man suffered a fractured eye socket and remains in Armadale Hospital and a 27-year-old Maddington woman received minor scratches

Armadale detectives are investigating.

On Thursday, May the 6th 2010, I went for a Doctors appointment and to my complete surprise found all the roads blocked into my street. Police would not let me into my home despite repeated requests to do so.

The Gosnells Council and over 20 police snuck into my yard and trespassed quite deliberately to begin hacking and cutting at equipment in the tree destroying much of it. My wife initially had no idea they were there.

I rang a friend and met them at the Thornlie train Station and we raced to document the event.

Much of the footage is exclusive and taken as they chopped down the tree and nearly took themselves out in the process.

The Council and police have told many lies. They repeatedly tried to say that I was inside the house and "snuck out" to make a scene - this is QUITE UNTRUE! They had CLEARLY been tapping my phone and were watching me leave my house. Is THIS what our police are used for now? SPYING on law abiding citizens? And for WHO? The Gosenell's City Council? It's nice to have friends in the "club". Whats the secret handshake so I can get in on the scene?

Myself and my family have always supported the Western Australian Police Force but I can tell you this whole experience has left a sour taste in the mouth. They were quite rude and repeatedly told me that I could return to my house the same way I came in - insinuating I had snuck out over a back fence.

In the end a camera man found his way in. I went to a friends house to cool off.

THIS IS JUST THE BEGINNING OF THE BATTLE!

Now a grass roots organization has been formed to assist in the education of the Australian public as to their rights and obligations UNDER the Australian Constitution as FREE MEN and WOMEN - not coming under the Un-Constitutional Acts and Statutes being passed willy nilly by our State Representatives.

Either know your RIGHTS under the Constitution of this country or be a slave.

Make up your mind.

Soon to come there will be many uploads of footage taken over the whole protest. And much more to come as I fight the Gosnells City Council to keep my home after they contemptuously cut down the tree suddenly while it was a matter being decided in court.

The 2010-11 State Budget handed down by Premier and Treasurer Colin Barnett today includes $1.005billion for expenditure on assets in the South Metropolitan region.

The Premier and Treasurer said the $286million surplus announced in today’s Budget reflected the Liberal-National Government’s disciplined economic stewardship during the recent global downturn and created a strong foundation for future growth and improved service delivery.

“Today’s $286million surplus will ensure the State Government can focus on ensuring services are delivered efficiently, effectively and fairly across the State,” Mr Barnett said.

“This is a great result for all West Australians and I would like to specifically welcome today’s announcement of major projects and improved service delivery for the South Metropolitan region.

“This ongoing level of support for important initiatives in the South Metropolitan region highlights the Liberal-National Government’s commitment to ensuring the benefits and opportunities of a strong economy are shared throughout Western Australia.”

Planning for Applecross Senior High has commenced for the $56million redevelopment of Applecross Senior High School. A staged construction program is expected to be applied and completed in 2013.

The extension and improvement in health infrastructure and services for the South Metropolitan region is further assisted in the 2010-11 Budget:

· Work will continue on the $1.76billion Fiona Stanley Hospital
· Work will continue on the $115million Rockingham Kwinana Hospital upgrade
· Work will start on the $256million new State Rehabilitation Centre.

The 2010-11 Budget also includes the biggest-ever injection of additional funding for the State’s health system, significant increases to child protection services, money to strengthen the community sector and support for young people and families.

Specific projects funded in the Budget for the South Metropolitan region included:

Education

· Applecross Senior High School - planning has commenced for the $56million redevelopment of Applecross Senior High School. A staged construction program is expected to be applied and completed in 2013
· Atwell College - construction will commence on the $31million Stage Two of Atwell College. This will enable the school to progress to years 11 and 12. The project is expected to be completed for the 2012 school year
· Aubin Grove Primary School - construction will continue on the new $15million primary school in Aubin Grove. The project will provide relief to Harmony Primary school and is expected to be completed for the commencement of 2011
· Comet Bay College - Stage 2 - construction has commenced on the $25million Stage 2 Comet Bay College enabling secondary students at the school to continue to Year 11 in 2011 and Year 12 in 2012. The new facilities will be designed to include innovative and state-of-the art facilities, comparable to world-class best practice. The new facilities are scheduled to be completed in 2011
· Rossmoyne Senior High School - construction has commenced on the $14million upgrade to facilities at Rossmoyne Senior High School. Works are expected to be completed for 2011.

Clontarf College
Royalties for Regions will provide funding of $5.04million over four years, including funding of $1.64million in 2010-11. The purpose of the funding is to set up additional football academies to be hosted by regional schools.

Health
· Work will continue on the $1.76billion Fiona Stanley Hospital
· Work will continue on the $115million Rockingham Kwinana Hospital upgrade
· Work will start on the $256million new State Rehabilitation Centre.

Housing
· Completion of a project at South Street, Beaconsfield, comprising 10 units at a cost of $1.5million
· Completion of a project across several sites in a high density precinct near the Meve Town Centre in Beeliar, comprising 12 units for families at a cost of $1.8million.
· Construction of 541 dwellings under State and Commonwealth stimulus programs.

Land Development - Golden Bay
· $14million for civil works
Development of Stage 1 has commenced and will create a total of 150 lots. The lots will be offered for sale to the general public with preference being given to first homebuyers and owner-occupiers.

Police
· Planning for the Cockburn Central Police Station (District Hub) to be located in Cockburn Central has commenced with funding of $20.6million provided over the forward estimates.

Perth Metropolitan Radio Network (PMRN) Expansion ($8.7million). The PMRN expansion extends the existing radio and mobile data communications north to Lancelin, east to Northam and south to Dunsborough. It also provides for the State-wide implementation of mobile data by public carrier. This will result in improving:

· police response times within the PMRN expansion area through the capability to dispatch tasks to the officers best placed to respond rapidly to emergency calls
· information availability through direct access to central databases
· officer security through vehicle location tracking and encrypted voice communications.

Transport
· $30.3million funding for the $155million Mandurah Entrance Road.

Perth Metropolitan will have access to:

· $220million over next four years for Safer Roads and State Black Spot programs.

Water
· Expenditure - approximately $31.1million
· Also in this region, $9.7million will be spent upgrading sludge treatment facilities at Woodman Point, the State’s biggest wastewater treatment facility in the latest of several upgrades to ensure this facility continues to operate at optimum capacity.

The Water Corporation will spend more than $3.4billion over the forward estimates period on essential projects across the State, recognising the ongoing need for major water and wastewater infrastructure developments. These projects are essential as WA continues to grow strongly.

In 2010-11, the Water Corporation will spend $1billion on capital works projects across WA, with about $339million allocated to dozens of smaller projects across regional WA.

FESA
FESA’s Budget for 2010-11 is $271.4million which represents an increase of $38.4million from last year’s Budget.

· $33.1million to continue with the construction of the Emergency Services Complex in Cockburn with completion expected in 2011-12 at an estimated total project cost of $51.6million
· Continued availability of a Type 1 helicopter for bushfire suppression in, and around the Perth metropolitan area and the Darling Scarp at a gross cost of $2.8million in 2010-11 ($11.9million over the forward estimates period).

Planning
· There is a need to safeguard natural assets, assemble land for industry and to acquire land required for highways, railways, ports and other infrastructure. Over $50million has been allocated to the Western Australian Planning Commission for the purchase of reserved land for the future of the State.
